Terms of Service

1. Agreement

By using orbika you accept these terms. The person who creates a business in orbika accepts them on behalf of that business, and confirms they are allowed to do so.

2. The service

orbika is booking, inventory and check-out software for rental businesses. It is provided “as is”. We improve it continually, so features may change; if we remove a feature in a way that materially affects you, we'll tell you in advance. Features described as “coming soon” aren't part of the service until they're released.

3. Accounts and roles

• Owners manage billing, settings and the team.
• Staff handle bookings and daily operations.

The business is responsible for who it invites and for everything done under its accounts. Keep your sign-in details safe and tell us straight away if you think someone else has used them.

4. Trial, plans and payment

• Every new business gets a 14-day free trial. No payment details are needed.
• Paid plans are billed in advance, monthly or yearly, in Indian rupees through Razorpay, and renew automatically until cancelled.
• Team members (seats) and extra-member pricing work as described on the pricing page.
• Taxes are as set out on the pricing page.
• We'll give at least 30 days' notice by email before changing the price of your plan. A new price applies from your next renewal after that notice.

5. Late or failed payment

If a payment fails, you keep full access for a 3-day grace period while Razorpay retries it. After that, the business becomes read-only until the payment is made. See the Refund and Cancellation Policy.

6. Cancellation, refunds and deletion

You can cancel at any time from Settings → Billing, and your plan keeps working until the end of the period you have paid for. Refunds are covered by the Refund and Cancellation Policy.

Business data is permanently deleted 60 days after the business becomes read-only, whether because of cancellation, trial expiry or non-payment.

7. Your data

Your business owns the data it puts into orbika. We use it only to provide and improve the service, as described in the Privacy Policy. You can export your data from Settings → Billing.

8. Fair use

Photo storage is unlimited under fair use, which means around 25 GB per business. If a business uses far more than that, we'll get in touch to talk about it before taking any action.

9. Acceptable use

You agree not to:

• store or share unlawful content;
• store personal data without a lawful basis for doing so;
• try to break or get around orbika's security, or access another business's data;
• resell or sublicense the service;
• scrape the service with automated tools; or
• overload the service or interfere with other businesses' use of it.

10. Suspension and termination

We may suspend or end access for non-payment or a serious breach of these terms, with notice where reasonable. You may cancel at any time.

11. Availability

We aim to keep orbika available at all times, but we can't guarantee uninterrupted service. There may be occasional maintenance windows.

12. Liability

To the extent the law allows, we exclude all liability not set out in these terms. Our total liability for any claim is limited to the fees you paid us in the 3 months before the claim. We are not liable for indirect or consequential loss, lost profits, or lost data beyond what our reasonable backup practices would have recovered.

13. Governing law

These terms are governed by the laws of India. The courts at Kollam have exclusive jurisdiction over any dispute arising from them.

14. Changes to these terms

We'll give notice of changes by email or in the app. If you continue to use orbika after the new effective date, you accept the changed terms.
